TERMS AND CONDITIONS FOR TRUSTILY LOAN APPLICATION

Welcome to Trustily Loan, a digital platform owned and operated by Trust Fintech Limited (“Company”, “We”, “Us”, or “Our”). These Terms and Conditions (“Terms”) govern your use of the Trustily Loan mobile application (“App”) and our website www.trustilyloan.in.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. LEGAL STATUS AND ROLE
Trustily Loan operates as a Lending Service Provider (LSP) and a Buyer Network Participant on the ONDC (Open Network for Digital Commerce) network. We provide a platform to facilitate the discovery and application of credit products (including Personal Loans, Gold Loans or any upcoming services) provided by Regulated Entities (Bank,NBFC or other financial institution).
Please note:
- Trustily Loan is not a bank or an NBFC.
- We do not directly lend money. All credit is provided by our partner Regulated Entities (“Lenders”) registered with the Reserve Bank of India (RBI). Financial data is accessed securely through our Account Aggregator partner Finvu, in accordance with RBI guidelines.
2. ELIGIBILITY
To use the App, you must:
- Be a citizen and resident of India.
- Be at least 18 years of age.
- Possess a valid Permanent Account Number (PAN) and Aadhaar card.
- Have a valid bank account in India with a Regulated Entity.
3. LOAN APPLICATION PROCESS
- Application: You may apply for Personal Loans, Gold Loans or any upcoming products through the App. You are responsible for providing accurate and up-to-date information.
- Credit Assessment: By using the App, you authorize Trustily Loan and its partner Lenders to fetch your credit report from bureaus (e.g., CIBIL, Experian) and perform KYC verification.
- Key Fact Statement (KFS): Before you execute any loan agreement, a KFS will be provided to you. This document will clearly state the loan amount, Annual Percentage Rate (APR), tenure, EMI, and all applicable fees/penalties.
- No Automatic Increases: Your credit limit will not be increased automatically without your explicit, recorded consent.
4. DISBURSAL AND REPAYMENTS
- Direct Disbursal: In compliance with RBI guidelines, all loan amounts will be disbursed directly from the Lender’s bank account to your bank account. No third-party pool accounts are used.
- Repayments: All repayments must be made directly to the Lender’s account through the App using authorized payment gateways (UPI, Net Banking, e-Mandate).
- Cooling-off Period: A cooling-off/look-up period (as defined in your loan agreement) will be provided, during which you may exit the loan by paying the principal and the proportionate APR without any prepayment penalty.
5. FEES AND CHARGES
- All fees, including processing fees, late payment charges, and documentation charges, will be disclosed upfront in the KFS.
- Trustily Loan does not charge users any "hidden" fees for the use of the platform. Any fees charged by the Lender are deducted or paid as per the loan agreement.
6. DATA PRIVACY AND SECURITY
- Data Collection: We only collect data that is necessary for providing our services (e.g., Identity, Income, and KYC documents).
- Permissions: The App will request minimal permissions (e.g., Camera for KYC, Location for compliance). We do not access your contacts, call logs, or private media files.
- Encryption: All data is transmitted over secure, encrypted channels.

7. ONDC NETWORK DISCLOSURE
As a network participant in the ONDC network, Trustily Loan acts as an intermediary to help you discover credit offers from multiple Seller NPs (Lenders). The final decision on loan approval, interest rates, and terms rests solely with the respective Lender.

We aim to resolve all grievances within 30 days of receipt.
9. LIMITATION OF LIABILITY
Trustily Loan shall not be held liable for any rejection of loan applications by Lenders, any errors in the credit reports provided by bureaus, or any disputes arising between you and the Lender regarding the loan terms.
10. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of India. Any disputes arising out of the use of the App shall be subject to the exclusive jurisdiction of the courts in Nagpur, Maharashtra.
